Terms of Use

Alpha Journal · Effective July 11, 2026

By creating an account or using Alpha Journal (the "app", "we", "us"), you agree to these Terms. If you don't agree, please don't use the app. These Terms contain a binding arbitration clause and class-action waiver in Section 11 that affect your legal rights — please read them.

Not financial advice. Alpha Journal is a personal journaling and educational tool that analyzes your own trading behavior. It is not financial, investment, tax, or legal advice, and nothing in the app — including AI-generated coaching, affirmations, statistics, or economic-calendar information — is a recommendation to buy, sell, or hold any security or to make any trade. Trading involves substantial risk of loss. You are solely responsible for your own decisions. Consult a licensed professional before making financial decisions.

1. The service

Alpha Journal lets you log trades, review statistics and discipline metrics, attach screenshots, and receive AI-based behavioral coaching and optional notifications. Features may change over time.

2. Your account

You must provide a valid email and keep your login secure. You're responsible for activity under your account. You must be at least 17 years old.

3. Acceptable use

4. Your content (user-generated content)

"Your Content" means everything you create or upload in the app — trades, notes, setups, emotions, screenshots, and feedback.

5. AI features & disclosure

Alpha Journal uses artificial intelligence. Coaching messages, reflections, debriefs, calendar explanations, and daily affirmations are generated automatically by an AI model (provided by Anthropic), based on the trading data and notes you submit.

6. Subscriptions

Some features may require Alpha Journal Pro, an auto-renewing subscription billed through your Apple App Store account. Price is shown in the app (e.g., US$9.99/month). It renews automatically unless canceled at least 24 hours before the period ends; manage or cancel it in your App Store account settings. Payments are handled by Apple; we don't receive your payment details.

7. No warranty

The app is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee that statistics, AI output, or third-party market data are accurate, complete, current, or error-free, or that the app will be uninterrupted or secure.

8. Limitation of liability

To the maximum extent permitted by law, we are not liable for any trading or investment losses, for any loss of data or Your Content, or for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app. Our total aggregate liability for any claim relating to the app will not exceed the greater of the amount you paid us in the 12 months before the claim or US$50.

9. Indemnification

You agree to indemnify and hold harmless Alpha Journal and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of Your Content, your use of the app, your violation of these Terms, or your violation of any law or third-party right.

10. Termination

You may stop using the app and delete your account any time. We may suspend or terminate accounts that violate these Terms. Sections that by their nature should survive termination (including 4, 7, 8, 9, 11) survive.

11. Dispute resolution & binding arbitration

Please read this section carefully — it affects your legal rights.

a. Informal resolution first. Before starting any formal proceeding, you agree to contact us at support@alphajournalapp.com and give us 30 days to resolve the dispute informally. Most concerns can be handled this way.

b. Binding arbitration. If we can't resolve a dispute informally, you and we agree that any dispute arising out of or relating to these Terms or the app will be resolved by final and binding individual arbitration, rather than in court, except as stated below. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, and may take place by phone, video, or written submissions where allowed.

c. Class-action waiver. You and we agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims.

d. Small-claims & IP exception. Either party may bring an individual claim in small-claims court, and either party may seek injunctive relief in court to protect intellectual-property rights.

e. 30-day opt-out. You can opt out of this arbitration agreement by emailing support@alphajournalapp.com with the subject "Arbitration Opt-Out" within 30 days of first accepting these Terms. If you opt out, disputes go to the courts identified in Section 12.

12. Governing law & venue

These Terms are governed by the laws of the Commonwealth of Virginia, USA, without regard to its conflict-of-laws rules. Subject to Section 11, the state and federal courts located in or serving Isle of Wight County, Virginia will have exclusive jurisdiction over any dispute not subject to arbitration.

13. Changes

We may update these Terms; continued use after an update means you accept the revised Terms. If we make a material change to Section 11 (arbitration), you may reject it by notifying us within 30 days.
